ACORD 855 (Pollution Liability)

A specialized ACORD application and evidence form used to document pollution liability insurance coverage for environmental risks.

Overview

The ACORD 855 form is associated with pollution liability insurance — a specialized coverage that protects against claims arising from the release of pollutants or contaminants into the environment. While the ACORD 25 is the standard certificate for general liability, auto, and workers' compensation, pollution liability is a distinct coverage line that requires specialized documentation. The ACORD 855 provides the framework for evidencing this environmental coverage.

How It Works

Pollution liability insurance covers the unique risks associated with environmental contamination. Standard Commercial General Liability (CGL) policies contain a total pollution exclusion that eliminates coverage for most pollution-related claims. Businesses with environmental exposure therefore need a separate pollution liability policy.

Pollution liability policies come in several forms:

  • Contractors Pollution Liability (CPL): Covers environmental contractors and remediation firms for pollution conditions caused by their work
  • Site-specific pollution liability: Covers a specific property for pre-existing or new pollution conditions

  • Limits and deductibles: Per-occurrence and aggregate limits, along with the self-insured retention
  • Covered pollutants: Whether the definition of pollutant is broad or limited to specific substances
  • Third-party claims: Coverage for bodily injury and property damage to third parties from pollution
  • Cleanup costs: Coverage for government-mandated or voluntary remediation expenses
  • Defense costs: Whether defense costs are inside or outside the policy limits

Compliance Relevance

Pollution liability documentation is critical for specific vendor categories in COI compliance:

  • Environmental contractors: Remediation, abatement, and demolition contractors must carry pollution liability, and the ACORD 855 or equivalent form evidences this coverage
  • Hazardous material handlers: Vendors transporting, storing, or working with hazardous materials require pollution coverage
  • Property transactions: Environmental due diligence in real estate transactions often requires evidence of pollution liability
  • Regulatory compliance: Many federal and state environmental regulations require proof of financial responsibility for pollution risks
